Important notice
These Terms apply to all users of the We Place You platform. Clauses marked “Candidate Exclusive” or “Employer Exclusive” apply only to that role — use the “Jump to” shortcuts in the sidebar to go straight to them. All other clauses apply to everyone.
1.1These Terms of Use (Terms) form a legally binding agreement between you and We Place You Pty Ltd trading as We Place You (WPY, we, us or our).
1.2These Terms apply to the We Place You website, candidate portal, employer portal, forms, communications, matching services, screening services, document-review services and related features (Platform).
1.3By creating an account, clicking an acceptance box, submitting a profile or vacancy, purchasing a service, electronically signing a document, or otherwise using the Platform, you agree to these Terms.
1.4If you accept these Terms for a company or other organisation, you confirm that you have authority to bind that organisation. In that case, “you” includes the organisation.
1.5If you do not agree to these Terms, do not register for or use the Platform.
2.1WPY operates a digital job-matching and candidate-introduction platform. Candidates can create profiles and provide career information and supporting documents. Employers can submit genuine vacancy requirements and request access to suitable candidates.
2.2WPY may review candidate information, conduct selected screening or verification steps, compare candidate profiles with employer requirements, prepare match results, and share authorised candidate information with Employers.
2.3Unless WPY expressly agrees otherwise in a separate written agreement, WPY does not conduct the Employer’s entire recruitment process and does not make the final hiring decision.
2.4WPY is not the Candidate’s employer and does not employ, engage, supervise, direct or pay Candidates. WPY is not a labour-hire provider under these Terms.
2.5The Employer is solely responsible for interviews, final checks, work-right verification, reference and background checks, role suitability, remuneration, classification, employment offers, employment contracts, onboarding, workplace safety and the employment relationship.
2.6Candidates remain responsible for deciding whether to engage with an Employer, participate in a hiring process or accept an offer.
2.7WPY does not guarantee that a Candidate will receive an interview or employment, that an Employer will fill a vacancy, or that any match, Candidate, Employer, job advertisement, employment offer or employment relationship will be suitable, accurate, available or successful.
3.1You must be legally capable of entering into these Terms. If you are under 18, you must have any parent or guardian consent required by law and must not use paid services unless a legally authorised adult approves them.
3.2You must provide accurate, current and complete registration information and promptly update it when it changes.
3.3You must keep your login credentials confidential, use reasonable security measures and promptly tell WPY if you suspect unauthorised access.
3.4You are responsible for activity performed through your account, except to the extent it results from WPY’s failure to use reasonable security.
3.5You must not sell, transfer, share or allow another person to use your account unless WPY has approved a multi-user Employer account.
You must use the Platform lawfully, honestly and only for genuine employment-related purposes. You must not:
5.1You retain ownership of resumes, profiles, job advertisements, documents, text, images and other material you submit (User Content).
5.2You give WPY a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, analyse, screen, verify, communicate and display your User Content only as reasonably necessary to operate, secure, improve and provide the Platform and services you request.
5.3For Candidate User Content, this licence includes creating a candidate profile, assessing matches and sharing authorised information with Employers in accordance with the Candidate’s choices, profile-sharing authority, Privacy Policy and collection notice.
5.4For Employer User Content, this licence includes reviewing, moderating, publishing and promoting genuine job advertisements and matching vacancy requirements with candidate profiles.
5.5You confirm that you own or have permission to provide your User Content and that WPY’s permitted use of it will not infringe another person’s rights.
5.6If you provide another person’s information, such as a referee’s details, you confirm that you are authorised to provide it and have given any notice required by law.
5.7WPY may remove, restrict or decline User Content that reasonably appears unlawful, unsafe, misleading, irrelevant, outdated or inconsistent with these Terms. Where appropriate, WPY will explain the reason and allow correction.
6.1You consent to receiving agreements, notices, account messages, match notifications, service communications and other documents electronically, including by email, portal notification or an electronic signing platform.
6.2You agree that a clear electronic action may show your identity and intention to agree. This may include clicking “I accept”, entering a typed name, using a one-time verification code, applying an electronic signature or completing another approved electronic process.
6.3WPY may keep electronic evidence of acceptance, including the accepted document version, account identifier, name, email address, date, time, IP address and available audit information.
6.4You must keep your email address and contact details current. A communication sent to your registered contact details is treated as received when it is capable of being retrieved, unless WPY receives a delivery-failure notice.
6.5Operational messages necessary to provide or secure your account are not marketing messages. Marketing consent is separate, optional and may be withdrawn using the unsubscribe method provided.
7.1WPY handles personal information in accordance with its Privacy Policy, relevant collection notices and applicable privacy laws.
7.2Candidates should review the Candidate Privacy Collection Notice before submitting a profile. Employers must comply with the Employer privacy and candidate-data obligations in these Terms.
7.3WPY will seek separate express consent where required before collecting, using or disclosing sensitive information.
7.4You may request access to, correction of or deletion of personal information as described in the Privacy Policy, subject to legal and operational retention requirements.
7.5No online system is completely risk-free. WPY will use reasonable safeguards, but cannot promise that unauthorised access or cyber incidents will never occur.
8.1WPY may conduct manual or technology-assisted screening and matching. The checks performed vary by Candidate, occupation, role, Employer request and information available.
8.2A label such as “verified”, “document sighted” or “pre-screened” only describes the specific check completed by WPY, the source used and the date of that check. It does not guarantee the Candidate’s complete identity, honesty, competence, conduct, legal eligibility or future performance.
8.3Unless explicitly stated otherwise, WPY does not independently authenticate every statement or document and does not replace the Employer’s final due diligence.
8.4Match scores, recommendations, rankings and shortlists are indicators based on available information. They are not hiring decisions and should not be the sole basis for an employment decision.
8.5WPY may correct or remove a verification status when information expires, changes, cannot be confirmed or is shown to be inaccurate.
9.1The Platform may integrate with or link to third-party services such as identity checks, video interviews, background checks, payment providers, cloud hosting, communication tools or employer websites.
9.2Third-party services may have separate terms and privacy practices. WPY is not responsible for a third party’s service except to the extent required by law or expressly stated by WPY.
10.1You may create a Candidate account, upload a resume and supporting documents, state your preferences and make your profile available for matching.
10.2Unless clearly disclosed before purchase, WPY does not charge Candidates for standard account registration, profile matching or introduction to Employers.
10.3You must provide information that is accurate, complete and not misleading, including your identity, contact details, employment history, qualifications, licences, availability and work rights.
10.4You must promptly update or correct information that becomes inaccurate, expired or incomplete.
10.5You must not include unnecessary sensitive information, government identifiers, financial details or information about another person in your resume or profile.
11.1By submitting a profile or document, you declare that the information is true and not materially misleading to the best of your knowledge.
11.2You must not alter, forge or misuse a qualification, licence, identity document, reference, work-right document or employment record.
11.3WPY may ask for clarification, updated evidence or permission to contact a source. You may decline an optional check, but this may limit verification or matching for roles that require it.
11.4WPY may suspend a profile while investigating credible concerns about false or unsafe information. WPY will provide a reasonable opportunity to respond unless doing so would create legal, safety or security risks.
13.1You decide whether to respond to an Employer, attend an interview, complete further checks or accept an offer.
13.2You must communicate professionally, attend agreed interviews or provide reasonable notice if you cannot attend, and avoid knowingly wasting an Employer’s or WPY’s time.
13.3You should independently assess the Employer, role, location, remuneration, employment type, working conditions and written employment terms before accepting an offer.
13.4An Employer may require further identity, licence, medical, reference, police, working-with-children, work-right or other checks where lawful and relevant. The Employer is responsible for explaining and lawfully conducting those checks.
13.5WPY does not provide legal, migration, tax, financial or career guarantees. Any general information is not a substitute for professional advice.
14.1Any employment or engagement is between the Candidate and the Employer. WPY is not a party to the employment contract unless a separate written agreement expressly states otherwise.
14.2The Employer is responsible for pay, superannuation, tax withholding, leave, workplace rights, safety, insurance, supervision, performance management and ending employment.
14.3Candidates should obtain and review written employment terms directly from the Employer.
15.1You may close your Candidate account or request deletion through the available account process or by contacting WPY.
15.2WPY may retain limited records where reasonably required for legal compliance, security, dispute handling, consent evidence, fraud prevention or enforcement of these Terms.
15.3Closing your account ends future matching and profile sharing, but does not automatically cancel an active hiring process already agreed with an Employer.
16.1You must be a genuine business, organisation or authorised hiring representative using the Platform for lawful employment-related purposes.
16.2You confirm that the person creating the account and submitting vacancies has authority to act for the Employer.
16.3You must provide accurate business, billing and contact information and promptly notify WPY of changes.
16.4Where an Employer account has multiple users, the Employer is responsible for managing access, removing departed users and ensuring each user complies with these Terms.
17.1Each submitted vacancy must be genuine, current, authorised and connected to a real hiring need.
17.2You must provide accurate and sufficiently clear information about the role, including title, duties, location, employment type, working arrangements, required skills, lawful eligibility requirements and remuneration information where requested or legally required.
17.3You must not advertise pay below the minimum legal entitlement that applies to the role, including any applicable award, enterprise agreement or National Minimum Wage.
17.4You must not include unlawful discriminatory criteria or wording. Any inherent role requirement must be genuine, lawful and reasonably necessary.
17.5You must not misrepresent visa sponsorship, employment status, contractor status, commission arrangements, unpaid work, training costs or other material conditions.
17.6WPY may review, reject, pause, edit for formatting, request evidence about, or remove a vacancy that reasonably appears unlawful, misleading, outdated, unsafe, duplicated or inconsistent with these Terms.
17.7WPY’s review or publication of a vacancy does not transfer the Employer’s legal responsibility to WPY.
18.1Candidate information is confidential and may only be used to evaluate the Candidate for the vacancy or another genuinely relevant role where the Candidate has authorised that use.
18.2You must not sell, publish, scrape, download in bulk, disclose, enrich marketing databases with, or use Candidate information for unrelated sales, advertising, lead generation or profiling.
18.3You may disclose Candidate information only to personnel and professional advisers who genuinely need it for the authorised hiring purpose and are subject to confidentiality and privacy obligations.
18.4You must use reasonable administrative, technical and physical safeguards, restrict account access and notify WPY promptly of suspected loss, unauthorised access or disclosure.
18.5You must keep Candidate information only for as long as reasonably necessary for the authorised purpose or as required by law, then securely delete or de-identify it.
18.6You must honour any Candidate correction, access or withdrawal request that WPY communicates to you, subject to applicable law and legitimate recordkeeping requirements.
18.7You must comply with applicable privacy, anti-discrimination, employment, workplace, migration, consumer and spam laws, whether or not a particular law would otherwise apply to your organisation.
19.1You are responsible for determining whether a Candidate is suitable and legally eligible for the role.
19.2Before making a final decision, you should independently verify information material to the role, including identity, work rights, qualifications, licences, references, experience and any lawful role-specific checks.
19.3You must conduct interviews, checks and decisions fairly, lawfully and consistently. You must not rely solely on a WPY match score, ranking or automated recommendation.
19.4You are solely responsible for any offer, employment contract, classification, remuneration, award coverage, workplace conditions, safety obligations, onboarding and ongoing employment management.
19.5You must not ask a Candidate to pay an unlawful fee, purchase unrelated products, transfer money or provide unnecessary financial credentials as a condition of employment.
20.1You may contact a Candidate only through the method and for the purpose authorised by WPY and the Candidate.
20.2Communications must be professional, relevant and not excessive, harassing or misleading.
20.3You must promptly tell WPY when a vacancy is filled, withdrawn or materially changed so matching can be updated.
20.4WPY may record a system-generated Candidate introduction or access event for security, service administration, billing and dispute purposes.
21.1You authorise WPY to use your business name, logo and vacancy content to publish the job and provide the requested service.
21.2You confirm that you have rights to the material you provide and that it is not misleading or infringing.
21.3WPY will not imply a broader endorsement, partnership or guarantee without your permission.
22.1Candidate availability, interest and information may change. A Candidate may withdraw, decline contact or accept another role at any time.
22.2WPY does not guarantee a minimum number of matches, applications, interviews, hires or employment duration unless a signed Order Form expressly states a measurable service commitment.
23.1Paid services, inclusions, usage limits, term, fees and any special conditions will be shown on the Platform, an accepted Order Form, proposal or invoice (Order).
23.2Unless stated otherwise, prices are in Australian dollars and exclude GST. If GST applies, it will be added to the amount payable.
23.3You must pay valid invoices by the due date stated in the Order or invoice.
23.4WPY will not impose a success fee, placement fee, subscription fee or other charge unless it has been clearly disclosed and accepted before the charge arises.
23.5If there is an inconsistency, the accepted Order prevails for the specific paid service, then these Terms.
24.1A subscription renews automatically only if this is clearly disclosed before purchase and you expressly accept the renewal arrangement.
24.2You may cancel renewal using the method stated in the Order or account. Cancellation stops the next renewal but does not usually end the current paid period.
24.3WPY will not materially increase the price of an active fixed-term Order before renewal unless you agree or the change is required by law.
24.4If WPY ends a prepaid service for convenience and you are not in breach, WPY will provide a reasonable pro-rata refund or credit for the unused portion.
25.1Refunds and credits are provided as stated in the Order and as required by the Australian Consumer Law.
25.2A failure to hire a Candidate does not itself create a refund right unless the Order expressly includes that commitment.
25.3You must raise a billing concern promptly and provide enough information for WPY to investigate. Undisputed amounts remain payable.
25.4WPY may suspend paid access for overdue undisputed amounts after reasonable notice and an opportunity to pay, except where immediate action is reasonably necessary to prevent fraud or loss.
26.1WPY and its licensors own the Platform, software, design, databases, trademarks, processes and content created by WPY, excluding User Content.
26.2WPY grants you a limited, non-exclusive, non-transferable and revocable right to use the Platform for the purpose permitted by these Terms during your account or Order term.
26.3You must not copy, modify, distribute, commercialise or create derivative works from WPY intellectual property except as allowed by law or written permission.
26.4If you provide feedback or suggestions, WPY may use them without restriction or payment, but will not publicly identify you as the source without permission.
27.1WPY aims to provide a reliable Platform but does not promise uninterrupted or error-free access.
27.2WPY may maintain, improve, replace or discontinue features. WPY will give reasonable notice of a material reduction to a paid service where practicable.
27.3WPY is not responsible for delay or failure caused by events outside its reasonable control, but will take reasonable steps to reduce the impact.
28.1You may stop using the Platform and close your account, subject to any active Order and outstanding payment obligations.
28.2WPY may suspend or restrict an account immediately where reasonably necessary to address suspected fraud, unlawful conduct, serious privacy or security risk, harassment, fake jobs, material misrepresentation, non-payment after notice or a serious breach of these Terms.
28.3For a breach that can reasonably be corrected, WPY will usually provide notice and a reasonable opportunity to fix it.
28.4WPY may terminate an account or service if the breach is serious, repeated or not corrected within the stated time.
28.5On termination, rights needed to resolve disputes, protect confidential information, enforce payment and comply with law continue.
29.1Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
29.2Subject to clause 29.1, the Platform is provided on an “as available” basis. WPY does not warrant that all User Content, job advertisements, screening information, verification outcomes, matches or third-party information are complete, current or error-free.
29.3WPY is not responsible for the acts, omissions, workplace practices, employment decisions or contractual performance of a Candidate, Employer or third party, except to the extent caused by WPY’s own breach, negligence or unlawful conduct.
30.1To the maximum extent permitted by law, neither party is liable to the other for indirect or consequential loss, loss of opportunity, loss of anticipated profit or reputational loss that was not reasonably foreseeable when the relevant service was supplied.
30.2Clause 30.1 does not apply to fraud, wilful misconduct, personal injury, breach of confidentiality, misuse of personal information, infringement of intellectual property, or liability that cannot be excluded by law.
30.3For an Employer’s paid service, and subject to clauses 29.1 and 30.2, WPY’s aggregate liability arising from that paid service during any 12-month period is limited to the fees paid or payable for that service during the same period.
30.4Where the law permits WPY to limit a remedy for failure to comply with a statutory guarantee, WPY may limit its liability to resupplying the services or paying the reasonable cost of having them supplied again.
31.1You are responsible for reasonably foreseeable loss, damage, cost or third-party claims to the extent caused by your unlawful conduct, material breach of these Terms, infringement of another person’s rights or misuse of confidential or personal information.
31.2An Employer is specifically responsible for claims arising from its unlawful or misleading vacancy, hiring decision, employment obligations or misuse of Candidate information.
31.3A Candidate is specifically responsible for claims arising from knowingly fraudulent documents, impersonation or material misrepresentation.
31.4You are not responsible under this clause to the extent the loss was caused by WPY or another person.
32.1Please first contact WPY at info@weplaceyou.com.au with your name, account email, the issue and the outcome requested.
32.2WPY will acknowledge a complaint within a reasonable time, investigate it fairly and aim to provide a response within 10 business days, or explain if more time is required.
32.3Before starting court proceedings, the parties should attempt in good faith to resolve the dispute through direct discussion and, if appropriate, mediation. This does not prevent urgent court action or a complaint to a regulator.
32.4Privacy complaints will be handled under the Privacy Policy and may also be raised with the Office of the Australian Information Commissioner where applicable.
33.1WPY may update these Terms to reflect legal, security, operational or service changes.
33.2WPY will publish the updated version and effective date. For a material change, WPY will provide reasonable notice through the Platform or registered contact details.
33.3A material adverse change will not apply retrospectively to an active fixed-term paid Order unless required by law or agreed by the parties.
33.4If you do not agree to an updated version, you may stop using the Platform and close your account, subject to any existing Order.
34.1These Terms are governed by the laws of Queensland, Australia.
34.2The courts of Queensland and courts entitled to hear appeals from them have non-exclusive jurisdiction.
35.1These Terms, the Privacy Policy, relevant collection notices, accepted consents and any accepted Order form the agreement for the relevant service.
35.2A special term or accepted Order prevails over these Terms only to the extent of an inconsistency for that service.
35.3If any provision is invalid or unenforceable, it is to be read down where possible and the remaining provisions continue.
35.4A delay in exercising a right is not a waiver.
35.5You may not transfer your account or agreement without WPY’s consent. WPY may transfer its rights and obligations as part of a genuine business restructure, sale or merger, provided this does not materially reduce your rights and applicable privacy requirements are followed.
35.6These Terms do not create employment, partnership, joint venture, fiduciary or agency relationships between WPY and a user.
